OFFICIAL RULES AND PARTICIPATION AGREEMENT
The 2007 Excellence in Advertising on Radio Awards (the “Contest”)
A completed registration on the contest website constitutes acceptance of these Official Rules and Participation Agreement. By agreeing to these Official Rules and Participation Agreement you are also agreeing to the website’s Terms of Use and Privacy Policy.
Creative Services Group, a division of Clear Channel Broadcasting, Inc., its parent, subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:
Eligibility
To be eligible to participate in the Contest you must register on the EAR Award’s site at www.EARawards.com, and work for an advertising agency, creative shop, production house, in-house creative department, radio broadcasting company or work as a freelance advertising writer or producer.
Term
The Contest will begin at 12:01 a.m. EDT on July 16, 2007 and end on 11:59 p.m. EDT August 24, 2007. The Company reserves the right to discontinue acceptance of entries after 2,000 entries have been received.
Entries Guidelines
An “Entry,” as defined herein, is an original radio spot which meets all guidelines described herein.
- Entries must be in an MP3 file format and no larger than 7MB.
- All entries must have been broadcast on a commercial U.S. radio station between July 14, 2006 and July 15, 2007.
- Entries must be a commercial advertisement 60 seconds in length or shorter.
- International entries are accepted, but spot must have aired on a U.S. radio station between July 14, 2006 and July 15, 2007.
- All non-English entries must include written English translation.
Entry categories for individuals are as follows:
- Best Radio Commercial Copywriting
- Best Use of Humor in a Radio Commercial
- Best Use of Music in a Radio Commercial
- Best Radio PSA/Pro-Bono
- Best Radio Station Produced Radio Commercial
- Best Use of Radio to Drive Consumers to the Web in Radio Commercial
You may submit multiple entries for various works you have created and/or participated in their creation. However, each entrant is allowed only one entry per category (maximum number of Entries per participant is six). You may also submit an Entry in multiple categories, should more than one category apply for that Entry. If an agency or agent enters for a creative team or another individual, one person must be designated as the official entrant into the Contest. The entry process does provide an area for additional credits so that each team member is recognized; however, for tax purposes prizes will be awarded to only one entrant.
The Best of Show category is open to agencies and creative shops only and will be awarded to the agency which represents the individual winner who has the best of show entry over all applicable categories.
Entries which do not meet the above requirements will be disqualified.
All Entries become the property of the Company and will not be returned or acknowledged. The Company is not responsible for lost, late, misdirected, incomplete, illegible entries or for any computer-related, online, telephonic, or technical malfunctions that may occur. Registration and entries will be considered void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced, or obtained through fraud or theft.
How to Enter
To submit an entry for the Contest, you must first register on the Contest web site at www.EARawards.com. To register, complete the on-line registration form. Entry deadline is 11:59 p.m. EDT on August 24, 2007. Valid contest entries must contain all information requested. Incomplete and/or multiple entries may be disqualified. The registration must state the category in which you are submitting your entry.
Warranty
By submitting your entry, you warrant and represent that the entry is an original work, created solely by you and/or your creative team and it does not infringe on any third party’s intellectual property rights, including copyrights, trademarks, or other proprietary or personal rights. You warrant and represent that the entry and all materials contained within the entry does not contain any materials owned or controlled by a third party for which you have not obtained a license.
Ownership and Licenses Granted
By entering the Contest, you hereby grant the Company a royalty-free, non-assignable, non-exclusive license to (a) reproduce the Entry as part of the review of entries of the EAR Awards; (b) distribute copies of the Entry to the EAR Awards judges as part of their review of the Entry; (c) display the Entry publicly to attendees of the EAR Awards award program and d) display the Entry publicly on the Official EAR Awards website. The Company shall not have any right to prepare derivative works based upon the Entry or to grant a sublicense hereunder.
Publicity and Use of Personal Information:
By participating, where allowed by law, all participants and winner(s) grant the Company and Participating Sponsors exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with the Contest and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company and Participating Sponsors may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
Judging
An independent panel of third party judges from the advertising industry will select 5 finalists for each category. A winner in each category will be selected from among the finalist by a separate panel of judges from the advertising industry. All decisions of the judges are final. The judging will be determined by a point system of 1 thru 20, with 20 being the best score, based on the following criteria:
Creativity – in concept, emotional connection, copywriting and production.
Delivery – way in which ideas, concepts and message have been presented.
Detail – elements included in the presentation and production.
Clarity – message is single focused and easily understood.
Originality – new and exceptional ideas in radio.
Production – quality of sound design, mixing, sound effects, music and sound bites.
The judges, in their sole discretion, reserve the right not to award a prize in any one particular category if (1) less than three entries are received in any one category, and/or (2) the entries received in any one category do not reach the standards of excellence necessary for the EAR Awards. If a prize in any one category is not awarded, the judges may, in their sole discretion (1) award that prize in one of the remaining categories (creating two winners in one category), or (2) not award that prize for the contest. In event of a tie in score the judges will deliberate to determine the winner.
Winner Notification
The Company will notify the winners within 7 days of determining the winners which will be on or about September 17, 2007. The winners will be notified from the information provided on the online registration form. If the Company cannot notify a winner from the information provided, the Company reserves the right to select another winner, in its sole discretion.
If a winner declines, fails to claim the Prize, fails to meet the requirements for fulfillment of the Prize, fails to abide by the Official Rules, or is ineligible, the Company may select a new winner in its sole discretion.
Prizes
The prizes that may be awarded to the eligible winners in each category are as follows:
Best Radio Commercial Copywriting
A Delta AirElite® Business Jet Fleet Membership for a private chartered jet for winner and five (5) guests. The membership includes a total of 10 hours of flight time to any destination within the Continental U.S. The prize may be used on one or multiple destinations if the destination(s) do not exceed the 10 hours of flight time. Some restrictions may apply approximate prize value: $50,000 USD). Best Radio PSA/Pro-Bono:

Best Radio Station Produced Radio Commercial
A Paris shopping spree in the amount of $20,000 on a prepaid American Express credit card. A trip package for the winner and one (1) guest to Paris, France. Trip package consists of non-refundable first class round-trip airfare for two to Paris (subject to availability); hotel accommodations for 5 days and 4 nights (total approximate retail value $15,000). Valid U.S. passport is required for travel. Winner & guest are responsible for securing valid passports. Trip must be booked at least 3 months in advance. Prize value may vary depending upon departure location and time of travel. Other restrictions and blackout dates may apply. All airport taxes, travel taxes and cancellation fees are the sole responsibility of winner (approximate prize value: $35,000 USD).

All prizes are subject to availability. Winners may elect cash equivalent for stated value for any prize with the exception of Best of Show. Any winner outside of United States must pay any shipping and handling fees from the U.S. in order to receive the prize. Grand Prize is Best of Show open to advertising agencies and creative shops only. The Grand Prize is subject to the restrictions below and not available for cash equivalent.
Best of Show:
$1,000,000 USD in advertising on Clear Channel Radio. Some restrictions apply*. (approximate prize value: $1,000,000 USD).
- The $1,000,000 can be used toward (1) advertising which is shorter length spots of 30 seconds or less, (2) New Media (new media is streaming, websites, pod casts on websites, and On Demand on websites), and/or (3) the cost of Creative Services Group, a division of Clear Channel Radio for creative services for radio spots or on-line video.
- The advertising can be use for: (1) new business from an existing advertiser not previously ordered (new business is any advertiser not on our air in last 13 months), or (2) a new advertiser.
- Political or ‘issue’ advertising is excluded.
- Clear Channel Radio reserves the right to approve all copy.
- Advertising used for airtime can run on any Clear Channel Radio station and can be used all in one market; however, such advertising must be spread evenly across all Clear Channel Radio stations in that market, provided inventory is available.
- Rates will be determined by Clear Channel Radio using best rate at time of placement.
- The entire $1,000,000 must be scheduled and aired within twelve months of the award date and placed 4 weeks before start date of said advertising.
- Advertising must be identified at time of order entry as part of the prize in whole or in part.
- Clearance would be handled like cash business in the ordinary course and client would receive invoices like all other business.
- Advertising can be used for one or several advertisers.
Clear Channel Radio reserves the right to refuse to broadcast any advertisements that do not meet the requirements of the rules, regulations, and policies of the Federal Communications Commission (“FCC”) and the policies of Clear Channel Radio, including, without limitation, sexual, ethnic, or racial content. Clear Channel Radio The Company further reserves the right to preempt any advertisements in the event of a local, state, or national emergency.
All Prizes are not transferable or exchangeable for any other prize. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or to not award that winner’s prize, in its sole discretion.
Taxes
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Release
By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
Conditions
Entrants release the EAR Awards, Creative Services Group, a division of Clear Channel Broadcasting, Inc., and Clear Channel Broadcasting, Inc., their respective parent, subsidiaries, affiliated companies, officers, directors, employees, divisions, agents, advertising agencies, and all others associated with the development and execution of the Contest, from and against any and all liability with respect to or in any way arising from this Contest and the awarding and use of the prize, including without limitation liability for death, personal injury, and/or disability.
Miscellaneous
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. The Company may substitute prizes, amend the rules, or discontinue the Contest at any time. Void where prohibited. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Compliance with Law
The conduct of the Contest is governed by the applicable laws of the United States, which take precedence over any rule to the contrary herein. All federal, state, and local laws and regulations apply.
